Surface & Stone LLC - Terms and Conditions of Sale
1. Orders & Payment
All orders are subject to manufacturer availability and acceptance by Surface and Stone LLC (“Seller”).
Full payment is required before an order is placed with the manufacturer unless otherwise agreed in writing.
Once an order has been placed, it may not be able to be canceled, modified, or refunded if it has already been processed by the manufacture.
Tile orders are shipped directly from the manufacturer to the address provided by the customer (“Buyer”).
Surface and Stone LLC (“Seller”) will act as a liaison between Buyer and the manufacturer for any shipping-related concerns, including damaged or missing materials.
Buyer must inspect all shipments immediately upon arrival and note any visible damage or shortage directly on the carrier’s delivery receipt before signing.
If damage or shortage is discovered, Buyer must notify Seller within 48 hours of delivery so Seller can coordinate a replacement or claim with the manufacturer.
Replacement materials are subject to manufacturer approval and lead times.
Seller will make every reasonable effort to assist with claim resolution but is not responsible for carrier delays, missed appointments, or additional delivery fees.
Buyer must inspect all materials prior to installation.
Variations in shade, tone, and texture are inherent in tile products and are not considered defects.
Installation of any tile constitutes full acceptance of the material as delivered.
Seller is not responsible for costs associated with removal, replacement, or installation of any product once installed.
Returns, if permitted by the manufacturer, are subject to manufacturer approval, restocking fees, and return freight costs.
Custom or special-order materials are non-returnable.
Returned materials must be in their original packaging and in saleable condition.
Samples are provided as a general representation of color, texture, and finish. Actual production may vary.
Natural stone, handmade, and specialty tiles may include inherent variations that add to their character. These variations are not grounds for claim or return.
Buyer is responsible for ensuring that all materials are installed by qualified professionals following industry standards and manufacturer guidelines.
Seller makes no warranty regarding installation, performance, or suitability of the products for any particular purpose.
Care and maintenance instructions should be followed per the manufacturer’s recommendations.
Seller’s liability is limited strictly to the replacement of defective materials prior to installation, and only if the defect is acknowledged by the manufacturer.
Seller is not liable for consequential, incidental, or indirect damages, including labor, installation, or delay costs.
